Terms & Conditions
These terms and conditions (the “Terms”) apply to your registration for and attendance of Fal.Con 2020 (the “Event”), and constitute an agreement between CrowdStrike, Inc. (“CrowdStrike”) and you or the entity you represent (“you”). BY REGISTERING FOR AND/OR ATTENDING THE EVENT, YOU ACKNOWLEDGE AND AGREE THAT YOU: (A) HAVE READ AND UNDERSTAND ALL OF THESE TERMS; (B) AGREE TO BE LEGALLY BOUND BY ALL OF THESE TERMS; AND (C) IF YOU ARE REPRESENTING AN ENTITY, YOU HAVE THE AUTHORITY TO REPRESENT SUCH ENTITY. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT REGISTER FOR OR ATTEND THE EVENT.
To register for the Event, you must complete the Event registration process and pay all required registration fees (if any) prior to any deadlines described on the registration page for the Event. Event registrations are subject to availability and may close earlier than posted deadlines. Attendees must be 21 years of age to attend the Event, and all related events. Requests for any exception to this requirement must be made in writing to CrowdStrike.
If the registration page for the Event states that registration fees or other fees are required for the Event, payment must be made via credit or debit card at the time you register for the Event. CrowdStrike reserves the right to cancel your registration without notice for failure to pay in accordance with these terms. CrowdStrike is not responsible for any damages, direct or indirect, resulting from such cancellation.
Cancellation By Us
The Event program, dates, times and sites are subject to change by CrowdStrike in its sole discretion. CrowdStrike may cancel the Event at any time and may deny, limit or cancel a registration for the Event (including a confirmed registration) at any time. CrowdStrike is not responsible for any damages, direct or indirect, resulting from such cancellation. If CrowdStrike cancels the Event or your registration (other than for a Force Majeure Event, as defined below), so long as you are in compliance with these Terms, CrowdStrike will issue you a full refund of any Event registration fee that you have paid.
Cancellation By You
No refunds will be given if you cancel your registration for the Event.
Mixed Media Release
In consideration of the opportunity to participate in the Event, you hereby irrevocably agree that CrowdStrike and its designees may record your likeness and voice in connection with the Event. You irrevocably authorize CrowdStrike to use, and hereby grant to CrowdStrike an irrevocable, nonexclusive, royalty-free right and license (including the right to sublicense) throughout the world and in perpetuity to reproduce, edit, publish, distribute or translate, for advertising, publicity and promotional purposes or for any other purpose relating to their business, all still photographs, audio, and video recordings, and any portions or versions thereof that CrowdStrike make of you or your voice or likeness in connection with the Event, including the right to use your likeness and any name or biographical information you provide in connection therewith. You consent to the use of the foregoing in perpetuity, in all manner and in all media worldwide without limitation, without compensation (unless prohibited by law) or additional consents from you and waive any moral rights you may have in the Items. You further acknowledge that CrowdStrike is the owner of all rights in and to the video, film or photograph of all attendees’ images. You understand and agree that any still photographs, audio, and video recordings, and portions or versions thereof, may without limitation be broadcast on all forms of film, television, print and radio, or be displayed or broadcast via the internet.
The information you provide to register for this event will be processed by CrowdStrike and CrowdStrike’s event vendor, George P. Johnson (www.gpj.com), to register you for the event and manage your attendance. Your contact details and other information will be used and handled by CrowdStrike in accordance with the information handling practices described in the Privacy Notice (https://www.crowdstrike.com/privacy-notice/). You consent to the collection, use and disclosure of the Event registration information in accordance with that Privacy Notice. CrowdStrike may use this information for legitimate business purposes, including to send details and announcements to you related to the Event, and communicate with you about other CrowdStrike offers, events or services. You can unsubscribe from promotional emails at any time by clicking the unsubscribe link in those emails. CrowdStrike may also access and/or disclose information if it believes such action is necessary to (a) comply with the law or legal process served on CrowdStrike, (b) protect and defend the rights or property of CrowdStrike (including the enforcement of our agreements), or (c) act in urgent circumstances to protect the personal safety of CrowdStrike employees or contingent staff, users of CrowdStrike services, or members of the public. CrowdStrike may also provide your contact information to third-party Event sponsors if (i) you elect to attend any sessions or other activities at the Event hosted by Event sponsors (in which case CrowdStrike would provide your contact information to only the Event sponsor(s) acting as host), or (ii) you opt in during registration to receive communications from such third-party Event sponsors.
Assumption of Risk
You acknowledge and agree that your attendance and participation in the Event is voluntary. You agree to assume the risks associated with attending and participating in the Event to the fullest extent permitted under applicable law.
Code of Conduct
You agree to behave in such a way as to create a safe, supportive learning environment while at the Event and any related events. You agree not to engage in disruptive speech or behavior or otherwise interfere with the Event or other individuals’ participation in the Event. You will comply with all applicable laws and agree not to engage in any form of harassing, offensive, discriminatory or threatening speech or behavior, including relating to race, gender, sexual orientation, religion or disability. CrowdStrike may require participants engaging or threatening to engage in such behavior to leave the Event or related event immediately and such participants will not be eligible to receive a refund of any fees paid to CrowdStrike related to the Event. If you witness such behavior, please promptly contact CrowdStrike so direct action can be taken. In its sole discretion and without refund, CrowdStrike reserves the right to refuse admittance to or expel from the Event anyone that it determines is behaving in a manner that could be disruptive to the Event or any other attendee.
CrowdStrike shall not be held responsible for any delay or failure in performance of its obligations hereunder to the extent such delay or failure is caused by fire, flood, strike, civil, governmental or military authority, acts of God, acts of terrorism, acts of war, epidemics, the availability of the venue or other similar causes beyond its reasonable control and without the fault or negligence of CrowdStrike or its subcontractors (a “Force Majeure Event”). For one or more Force Majeure Events, CrowdStrike may postpone, reschedule or cancel the event without liability on the part of CrowdStrike. If the Event cannot be held or is postponed pursuant to this section, CrowdStrike shall not be liable to attendee for any damages, costs, losses, or other financial losses.
IN NO EVENT SHALL (A) CROWDSTRIKE BE LIABLE FOR ANY LOSS OF DATA, LOSS OF PROFITS, LOSS OF OPPORTUNITY, COST OF COVER OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY OR RELIANCE DAMAGES ARISING OUT OF OR RELATING TO THE TERMS OR THE EVENT, UNDER ANY LEGAL THEORY, EVEN IF CROWDSTRIKE KNOWS OF OR SHOULD HAVE KNOWN THE POSSIBILITY OF SUCH DAMAGES, OR (B) THE AGGREGATE LIABILITY OF CROWDSTRIKE TO YOU FOR ALL OTHER DAMAGES IN CONNECTION WITH THE EVENT EXCEED THE GREATER OF: (I) $50, OR (II) THE FEES PAID BY YOU FOR THE EVENT. To the extent permissible by applicable law, you (for yourself, your heirs, personal representatives, assigns, and anyone else who might make a claim on your behalf) hereby release CrowdStrike and its affiliates, and their respective directors, officers, employees, contractors, representatives, agents, successors and assigns, from any and all claims, demands, causes of action, suits, damages, losses, debts, liabilities, costs and expenses (including without limitation reasonable attorneys’ fees and costs) that you may have now or in the future associated in any way with the Event.
The Terms shall be governed by and construed in accordance with the laws of the State of California and the parties hereby consent to the jurisdiction of California’s courts over all matters relating to these Terms. This Agreement constitutes the complete agreement between the parties and supersedes all prior or contemporaneous agreements or representations, written or oral, concerning the subject matter hereof. This Agreement may not be modified or amended except in a writing signed by a duly authorized representative of each party.
